The U.S. Food and Drug Administration has put its money where its mouth is and on Dec. 6, took action against Sacramento, CA-based Enhanced Athlete, which is affiliated with Charles Anthony Hughes, aka “Dr. Tony Huge.” The agency seized raw materials and finished and unfinished products, which contain selective androgen receptor modulators (SARMs), reportedNatural Products Insiderin an exhaustive study of the investigation.

On Oct. 31, Donald Ashley, J.D., director of the Office of Compliance in the FDA’s Center for Drug Evaluation and Research, expressed its extreme concern about “unscrupulous companies marketing body-building products with potentially dangerous ingredients.”

In an unusual action, five trade associations joined with the U.S. Anti-Doping Agency (USADA) to issue a Nov. 8 press release announcing theirunited support of the FDA actionsto protect consumers from body-building programs containing SARMs and illegally marketed as dietary supplements.

Banding together were the American Herbal Products Association (AHPA), the Consumer Healthcare Products Association (CHPA), the Council for Responsible Nutrition (CRN), the Natural Products Association (NPA), the United Natural Products Alliance (UNPA), and USADA.

“UNPA continues to support full enforcement by FDA against companies that include SARMs in their products,” Loren Israelsen, president of UNPA, toldWholeFoods Magazine. “SARMs are not approved for human use or consumption in the United States and have been found to be dangerous for consumers, especially since they are often not included on product labels. We acknowledge and agree with FDA’s Oct. 31 warning to the public about these ingredients and the fact that they are adulterated products masquerading as dietary supplements. We will continue our work to ensure that the American public has continued access to dietary supplements that are safe, of high quality and based on valid science.”

Enhanced Athlete CEO Scott Cavell toldNatural Products Insiderthe FDA and other government organizations executed a search warrant on Dec. 6 at several locations, including a manufacturing facility it controls, seeking to find and confiscate ostarine, 2,4-Dinitrophenol (DNP) and other research chemicals.

FDA seized raw materials and hundreds of thousands of dollars in finished and unfinished products, reportedNatural Products Insider.

“We believe this to be the first time that the FDA’s criminal investigation unit has executed a search warrant related to SARMs," Enhanced Athlete noted in a statement, which was referenced by its followers on the company’s website,Natural Products Insiderreported.

Added the statement: “Tony has always believed that SARMs are nearly as powerful as steroids in the correct dosages. This will come to the realization of the FDA and other government authorities eventually, if it hasn’t already. This means that the window of opportunity is closing on SARMs,"Natural Products Insiderreported.
